Discord said it relied on a “court order” to shut down the service, but details are still unclear. Here’s what we know.

In March, Nintendo filed a lawsuit against another Switch emulator, Yuzu. The case was settled, but Nintendo did not obtain the rights to Yuzu’s open source code. In Discord, Yuzu’s forks Suyu and Sudachi were targeted. The platform’s DMCA policy applies to specific infringing content, not to all servers. Additionally, Discord did not provide detailed information about the copyright violation. The court’s decision was directed at parties “acting in concert” with Yuzu, and Discord has not confirmed any connection between Suyu/Sudachi and Yuzu developers.

Although Nintendo has issued takedown requests, Discord’s actions appear “excessive” to experts. Permanent bans and server deletes are generally applied to repeat offenders, not first-time offenders.

Fortunately, Sudachi’s development continues. He continues to take an active part in developer projects.
