The resolution states that we are talking about a package of draft federal laws aimed at creating conditions for the activities of aggregators of information about goods and services in order to regulate electronic commerce in Russia.

A draft law on state regulation of markets is already being considered in the State Duma; The measures presented in it, in particular, prohibit the buyer from paying for the return of the goods. The project also defines the concept of “significant market position” for markets.

The bill submitted to the State Duma was criticized by the Federal Antimonopoly Service (FAS). The agency prepared more than 40 comments on the document, including the risk of evasion of regulation by platforms, conflicts in the concept of “large intermediary platform” and possible negative consequences for retail trade.

In September 2023, the law on antimonopoly regulation of markets came into force in Russia. The FAS has prohibited markets whose revenues exceed 2 billion rubles in the last year and whose percentage of transactions in a given product market exceeds 35% from abusing their dominant market position.
