The Ministry of Economy is developing a new law together with the Ministry of Industry and Commerce, the Ministry of Digital Development and the Analytical Center for Strategic Research. The amount of fines for violating it varies depending on the markets and partners (sellers).
The main fine for officials and legal entities ranged from 20,000 to 40,000 rubles and from 100,000 to 500,000 rubles, respectively. For repeated violations, legal entities can be fined up to 800 thousand rubles, and fines for officials will amount to up to 50 thousand rubles.
The highest punishment will be imposed for violation by markets of the requirements for publishing offers from sellers (works, goods and services); In this case, the first fine for an official can range from 60 to 100 thousand rubles, and for a legal entity. – from 500 thousand to 1 million rubles.
The repeated charge for legal entities can amount to 1 or 2 million rubles, for officials – from 100 to 200 thousand rubles.
The minimum fine for an official of a partner will be 10 thousand rubles for the first violation of the law. For legal entities and individual entrepreneurs, such amounts will amount to 100 thousand and 50 thousand rubles, respectively. A repeated violation will cost an official 20-40,000 rubles, an individual entrepreneur – 100-200 thousand rubles, and a legal entity – 300-500 thousand rubles.
The Law “On the Platform Economy” proposes to recognize the nature of the relationship between platforms and order performers as civil law, and not as labor law, as well as providing additional protection of consumer rights and better exchange of tax information between the Federal Tax. The new law will affect not only the traditional Ozon and Wildberries markets, but also taxi aggregators, food delivery services, the selection of service providers and the booking of tourism products.
Deputy Prime Minister Dmitry Grigorenko announced on November 23 that the bill will be submitted to the State Duma for consideration in early 2025, and the document is now being agreed with market participants.
