“Alcohol Production Company LLC informs that an extraordinary general meeting of APK LLC participants made a decision to liquidate the company and appoint MI Stakhov as liquidator. Creditors’ claims can be submitted within two months from the date of publication of the message on Vestnik. state registration of the magazine,” the card says.
On August 15, the Moscow Arbitration Court arrested the assets of the agro-industrial complex for 6.82 billion rubles at the request of the Office of the Federal Tax Service (UFNS) for the Ulyanovsk region, as follows from the materials of the arbitration file. cases. In September the process in this case was suspended.
The third party in the case is Alpha Lux LLC, from which the Federal Tax Service tried to recover 4.4 billion rubles in 2023. Lawyers interviewed by Vedomosti said then that the tax office could try to collect Alfa Lux’s debt to the AIC, since it was this company that initially produced Baikal and Nerpa vodka, and the AIC began producing them in 2022. The lawyers also said that the agro-industrial complex will most likely not be able to cope with payments and will go bankrupt.
The company’s initiative to liquidate means that a simplified bankruptcy procedure will be initiated, arbitration director Tatyana Pugacheva explained to the newspaper. These tactics may be aimed at introducing a “controlled” bankruptcy on the part of the debtor to preserve its assets, he clarified.
At the same time, “there are no prospects for exemption from tax claims,” noted Valeria Tikhonova, project director of the bankruptcy department of the Vegas Lex law firm. According to her, if the arguments of the Federal Tax Service that the activities of Alfa Lux were transferred to the agro-industrial complex are confirmed, then the tax authorities will be able to “access the assets of the group of companies.”
In 2023, APK LLC’s revenue amounted to 4.5 billion rubles, an increase of 17% compared to 2022. The company’s net profit at the end of last year amounted to 12 million rubles, which is a year-on-year increase of 9%, according to data from Rusprofile.
