The court will assess the real consequences of the seller's actions in the sale of low-quality goods, reports Izvestia.
The damage from the purchase will need to be documented. For example, if when buying low-quality cosmetics, the buyer received a chemical burn, which was recorded by contacting a doctor.
The customer can also conduct an examination of a low-quality product and, by filing an application with the court, ask the seller to reimburse the costs of its implementation.
The specialist of the law firm Yalilov & Partners, a member of the Russian Bar Association, Alsina Galliamova, added that the online store is not responsible for the violation of the rights of buyers and copyright holders if it occurred through the fault of the seller.
At the same time, amendments to the consumer protection law came into force two years ago. The document says that the owner of the market is responsible for losses caused to the consumer as a result of providing him with false or incomplete information about the product or the seller, on the basis of which the consumer entered into a sales contract with the seller, explained the attorney.
The buyer also has the right to demand from the owner of the aggregator the return of the amount of the merchandise, which must be returned within 10 calendar days from the date of the request.
However, two conditions must be met for this: the goods were not transferred on time, and the consumer sent the seller a notice of refusal to execute the contract of sale due to a violation of the transfer deadlines.
In early July, Vladislav Zaslavsky, director of the Department of Digital Labeling of Goods and Legalization of the Circulation of Products at the Ministry of Industry and Trade, said that Wildberries were becoming a distribution channel for counterfeit products, but the market was ready. to take action. to prevent such sales.
The market's press service then reported that "information about the sale of counterfeit products by Wildberries is not true."
