A year after burns from a Moto G9 Play that caught fire in his pocket, the victim should be compensated R$ 12,000🇧🇷 The lawsuit took place in November 2021 and the cell phone owner sued Motorola and Via.

The user’s cell phone was in his pants pocket. The device, manufactured by Motorola, was sold by Casas Bahia and used for one year, purchased in November 2020 for around R$1,200. At the time of the incident, the smartphone was still under warranty.

In the lawsuit, the owner of the Moto G9 Play claimed: Second-degree burns occurred on his right hip. He also said he took the phone to Motorola’s technical assistance so that the amount paid was replaced or refunded.

However, the manufacturer denied the allegations, arguing that it was abuse. Thus, the case was settled in court in the 3rd Civil Court of the São Paulo Court of Justice (TJSP). In addition to the reimbursement of the payment, the owner claimed compensation of R$ 10,000 for non-pecuniary damage.

Continuing the allegations of abuse, Motorola and Via decided to appeal. The cell phone brand says this is due to “high mechanical effort from pressure or impact.” The seller claims it is in perfect condition at the time of sale.

In addition, according to the expert report, there is also the statement that “the explosion of the device occurred as a result of the negligence of the user”. The trial judge, Paulo Luis Aparecido Treviso, rejects this award on the grounds that it was unilateral in favor of Motorola.
