The Supreme Court confirmed a citizen of Volgograd in a dispute with the Central Department Store, who bought 19 items of clothing for 2,787 rubles, 846 times cheaper than the real price. There was a failure in the store’s service, which the buyer took advantage of, but TSUM did not like it, and the case went to court: in the first three instances, TSUM won, but lost in the Supreme Court.
The Supreme Court sent for a new trial the case of a dispute between a Volgograd resident and the Central Department Store over a purchase that cost the buyer much less than the actual price. It is reported by RIA Novosti.
A citizen of Volgograd was able to buy 19 items of clothing in the Central Department Store at prices ranging from 19 to 129 rubles; the total amount of the purchase was 2,787 rubles, which is 846 times less than the actual price.
At TSUM, they explained the situation as a failure, refused delivery to the buyer and returned the money. The buyer decided to sue and lost in the first three instances, but received support in the Supreme Court.
The Supreme Court clarified that the price of the goods is fixed at the time of placing the order, and the offer to sell clothing is a public offer, after which the seller is obliged to transfer the goods to the buyer and has no right unilaterally change the price.
