Tinkoff requested the consent of 30 million customers to process their photographs taken when registering banking products and convert them to the format, including vectors, of the Unified Biometric System (SUB). To avoid entering the EBS, users must express their refusal explicitly by contacting the bank, Kommersant reports.
The bank began collecting authorizations at the end of September. At the same time, Tinkoff did not spend money on SMS or push notifications, but only posted a message in the “story” at the top of its mobile application.
The bank’s clients were outraged that in the appeal the bank only provided the opportunity to accept this proposal. Users will be able to send a refusal via Russian Post or contact the bank personally, including using remote service services.
The photograph itself is not considered biometric until the customer consents to its processing. All photographs were usually taken by couriers delivering banking products.
According to Artem Dmitriev, managing partner of Comply, if Tinkoff collects consent to recategorize previously collected personal data and convert it to biometric and transfer it to EBS, then this will not work; Obtaining consent for processing after the fact is illegal.
The bank now formally has two options: obtain customer consent and transfer the data to the EBS, or completely remove the information from its system.

The user may refuse to transfer data to the system within 30 days. Commenting later on the issue of sample quality, the department explained that it is set by the Ministry of Digital Development. If the information transmitted turns out to be of poor quality, it can only be used when receiving the services of the company that provided the data.
