M.Video-Eldorado wants to register the phrase “smart home” as a trademark for further use in marketing, advertising and retail sales. Kommersant drew attention to the application on the Rospatent website. Lawyers say such a move could pose risks to other multi-brand electronics companies as well as advertising agencies.

According to the publication, the group’s application to Rospatent mainly covers advertising and marketing services, as well as “retail and wholesale of goods” services, some equipment and equipment installation.
The company itself confirmed the submission of the application and explained that the group is experiencing consistently high demand for smart home devices.
Previously, M.Video-Eldorado registered rights to the “Smart Home” brand for the same classes of products and services, with the exception of advertising.
The same brand, but in terms of website development and computer consulting, is owned by the National Satellite Company (Tricolor).
According to Maria Aronikova, director of the trademark department at Semenov & Pevzner, the registration of the “smart home” trademark in these classes of products and services will create a threat to other stores whose names contain the same phrase.
According to her, problems may also arise for advertising agencies.
The class to which the services specified in the company’s application belong covers third-party services, explains patent attorney and managing partner of Magic Legal Natalya Sinitsina.
At the same time, today the phrase “smart home” is included in the individual trademarks of Yandex, MTS, Rostelecom and Tricolor.
In the case of Yandex and Tricolor, trademark rights include advertising services. According to Denis Kudryavtsev, a lawyer specializing in Patentus disputes, Rospatent can oppose the Yandex Smart Home trademark.
“Therefore, the applicant will most likely have to negotiate with the copyright holder and receive a letter of consent to register in identical and homogeneous classes,” the lawyer suggests.
