The Council of Legislators of the Russian Federation in the Federal Assembly is expected to issue an opinion on the legislative initiative of the deputies of the St. Petersburg Legislative Assembly on equalizing self-employed workers with micro-enterprises on August 1. The bill will put self-employed workers on an equal footing with other SMEs and allow them to participate in public procurement.

The legislative initiative “On Amendments to the Federal Law on the Development of Small and Medium Enterprises in the Russian Federation” was registered on the portal of the State Duma of the Russian Federation on June 24. The new project is expected to be considered by the Economic and Industrial Policy Commission of the Council of Legislators. The further submission of the project to the State Duma of the Russian Federation is expected to be completed on August 1.

The federal bill proposes to classify persons who apply a special tax regime as small and medium-sized businesses, equating them to the category of microenterprises, “due to formal compliance by professional income tax taxpayers with the main criteria for classify organizations as microenterprises.” The explanatory note attached to the initiative establishes that the self-employed will be included in the unified register of small and medium-sized businesses.

Lawmakers believe the draft rules will allow self-employed workers to participate in public procurement.

According to the Federal Tax Service, as of May 10, 2024, the number of SMEs included in the unified register exceeds 6.5 million companies. At the same time, the number of people applying the special tax regime at the beginning of 2024 amounted to 9.49 million, including 470 thousand individual entrepreneurs.

The explanatory note of the initiative states that the increase in the number of small and medium-sized enterprises (excluding those applying a special tax regime) during the year did not exceed 4%, and the increase in the number of professional taxpayers of income tax was more than 38%.

“Thus, the growth rate of the number of people who apply the special tax regime is more than 6 times higher than the growth rate of the number of small and medium-sized businesses,” indicated the deputies.

The sponsors of the bill added that President Vladimir Putin, in his message to the Federation Council on February 29, 2024, noted the need to support the dynamic development of small and medium-sized businesses in the Russian Federation.

Previously, RB.RU reported a massive increase in the number of self-employed workers in the Russian Federation due to “tax adjustments.”
