The Intellectual Property Court has recognised deepfakes as copyrightable. This is stated in the ruling following a legal case between two Russian companies, published on the e-justice website. Deepfakes are a tool for processing videos, not for creating them, the court was told.

Reface Technologies sued Business Analytics for 500 thousand rubles in a copyright protection case over a deepfake.

Agenda Media Group was commissioned by Reface Technologies to create an advertising video in which film actor Keanu Reeves checks whether he has turned off his iron when leaving the house. Business Analytics downloaded this video and used it for its own purposes.

Reface Technologies went to court to protect the copyright of the video and won. The court ruling states that deepfakes are a tool for processing videos, not creating them.

“This victory sets an important precedent for the protection of works created using neural networks and demonstrates that even the most modern technologies should be used ethically and protected by copyright law,” said Alexey Parfun, Managing Partner of ReFace Technologies.

The Intellectual Property Court’s ruling is final and cannot be appealed.
