The Court supported the sub -court’s decision, which concluded that FTC’s unification of Microsoft and Activision would lead to a significant restriction of competition in the market. The three judges unanimously admitted that the first decision was true, and the FTC did not provide enough evidence for temporarily suspended the transaction.

In 2022, FTC filed a lawsuit against Microsoft and claimed that the acquisition of Activision Blizzard would violate antimonopolic laws, because Microsoft will allow Microsoft to rule the video game market, including Xbox consoles and cloud services. However, the court rejected these allegations.

The agreement with Activision Blizzard has become the largest game industry in the history of the game industry. Although it was successfully completed in 2023, the agreement faced the attention of the regulatory authorities in the UK and other countries. Now FTC will continue to appeal in other ways.
