The case began in late 2023, when the NYT filed a lawsuit against OpenAI, claiming the company used the paper’s materials to train its models. In May 2025, a court ordered OpenAI to store all chats so journalists could investigate the allegations. OpenAI objected, saying the requirement was a privacy threat.

OpenAI no longer needs to record chats after September 26, with limited exceptions. Data already maintained under the previous order will remain available for inspection. The company is also required to retain information about users flagged by the NYT to check for possible violations.

NYT may continue to expand the list of such users and review recorded logs.
