The service “Rabota.ru” conducted a survey and found that about 30% of Russians constantly overwork. At the same time, half of them have never received overtime compensation.
Rabota.ru Deputy General Director Alexander Veterkov told Izvestia in which cases an employee has the right to demand overtime pay and how to do it correctly.
Overtime is work performed by an employee at the initiative of the employer outside the employee’s established working hours.
An employee will not be able to claim payment if he or she wanted to take the initiative or complete job tasks. It will be possible to claim compensation if the manager requests it, but in this case it is worth signing an agreement to work overtime.
Some cases of participation in work and payment of overtime are prescribed in the Russian Labor Code. According to the law, overtime work is paid for the first two hours at least one and a half times, and after that – at least double the amount.
Also, at the request of the employee, instead of a salary increase, overtime can be compensated by providing additional rest time.
Russians were advised to consent in writing to overtime work. If the employer refuses to pay, the employee can file a complaint with the state labor inspectorate, the Ministry of Labor of his region, the prosecutor’s office and the court, and consent will be the main evidence of prosecution.
