Yesterday Apple ordered suspend sales of Apple Watch Series 9 and Apple Watch Ultra 2 in the USA from December 21. Cause? This is a preventive measure as they are involved in a lawsuit with medical technology company Masimo.

While Masimo is willing to negotiate with Cupertino to prevent the situation from escalating further, it appears that Apple is choosing to take a different route. The above, of course, angered Director Masimo.

As we informed you a few hours ago, Apple engineers work against the clock change a number of algorithms that allow you to measure blood oxygen saturation using the Apple Watch. The current proposal obviously infringes the patent.

However, in an interview with the publication BloombergJoe Kiani, CEO of Masimo, stated that doesn’t believe Apple can make enough changes and get the same result. It is for this reason that the aforementioned company was, from the very beginning, open to reaching an economic agreement with those led by Tim Cook to use its method.

So what’s the problem? Well, Apple is confident that they will find a profitable solution. In fact, they are also preparing legally for a possible dispute with Masimo.

Kiani said that at the moment Apple didn’t call them despite how easily agreement can be reached. They then also begin to sense that a deeper legal battle could break out in a matter of days. Of course, they feel in a good position to emerge victorious.

“I don’t think it can work, and it shouldn’t, because our patents have nothing to do with software,” he said. If this is indeed the case, it will be very difficult – if not impossible – for Apple to set up its hardware in a matter of days. Not only because of how complicated it is, but also because there are already millions of Apple Watch Series 9 and Apple Watch Ultra 2 units available on the market.

“These kids were caught with their hands in the cookie jar,” Kiani said. On the other hand, he made it clear that if Apple finally decides to negotiate, you should apologize first, otherwise it will not be possible to open the dialogue. So, we are faced with a battle for pride that, barring an unexpected twist, is unlikely to ever end.

Interestingly, in 2013, Apple expressed interest in buying Masimo to acquire all of its medical technologies, but the situation apparently did not develop. However, Apple managed to lure some engineers and add them to its ranks. Obviously, there has been tension between both companies for a decade now, but nothing compared to what is happening now.
