“Dignity, freedom and justice for all”. With this slogan, the 74th anniversary of the Universal Declaration of Human Rights was celebrated this Saturday. On December 10, 1948, the UN General Assembly adopted a historic document establishing the inalienable rights that every human being has as a human being.

The Nation’s Attorney General, Margarita Cabello Blanco, spoke to this chronicler about that memorial, and it wasn’t exactly to celebrate. The exact opposite. The head of the Public Ministry does not hide his great concern about the current state of human rights in our country. I begin the dialogue with the following question:

We are witnessing an unfortunate increase in violence in various parts of the country. We are extremely concerned about the escalation of attacks and violence against our social leaders.

199. Inadmissible.

It has resulted in serious human rights violations for this transitional population, who are victims of exploitation, smuggling and smuggling, among others.
There are also complaints about human rights violations in prisons.
The Constitutional Court’s decision SU-122 shows that the serious human rights situation continues in prisons, police stations and emergency response units.

The Office of the Attorney General has been extremely attentive to the situation of immigrants in Darién Gap. Moreover, we have organized a visit to the region in recent days, in which we called upon the authorities of the national order, such as the director of Colombian Immigration, the military leadership, the ICBF, among others, to guarantee the rights of this population. We have been able to verify first-hand the conditions of the migrant population and we will be vigilant by verifying that the National Government and local authorities guarantee rights.

We work to promote the defense of human rights through our authorized lawyers, accompanying communities, leaders, human rights defenders, and warning the authorities to take timely measures prescribed by law. and communities.

Directly, as the Nation’s Attorney General, I was responsible for leading many of these areas of dialogue in the various regions. A few days ago I was dealing with the situation at Bajo Cauca in Nariño Pacific.

Any human rights violation is unacceptable. However, violations of human rights by illegal armed groups and multi-criminal organizations have serious effects on regions and civilian populations. We also see that the immigrant population and the prison population violate human dignity. These populations face very dangerous conditions. In addition to the right to health and food safety, the right to life and the right to personal integrity unfortunately constitute the most violated human rights in our country.

Respect for human rights starts with respecting differences and the opinions of others. Acknowledging and accepting our differences and creating public policies and actions in a participatory way is key to advocating for human rights.

Yes, we must increase the State’s presence on the land through investments in infrastructure, health, education, among others.

Undoubtedly, the most violators of human rights in Colombia are illegal armed groups such as the ELN, opposition groups or the GAO (remnants of the former FARC), the “Clan del Golfo” and other multi-criminal groups. organizations existing in this country. It is all this accumulation of illegal violent actors that are largely responsible for the human rights violations we experience on national soil.

The ‘Márquez’ case could be one of the biggest obstacles to the success of future peace processes. This person has repeatedly violated peace agreements and, above all, violated the victims of the conflict. For me, it is very difficult for his record to justify why it is now possible to negotiate with him and accept peace.

If you insist on integrating it into a new negotiation process, you will have to add extensive explanations and justifications for it to abandon previous behavior and previous processes. If this is not done, a perverse precedent remains for future peace processes, as everyone may return to arms and wait for new opportunities for renegotiation.

Dialogue is a correct and necessary way to resolve a conflict as part of the exploratory phase where initial decisions are made. We hope the parties have a will. The Attorney General’s Office will always be ready to support peace scenarios within the framework of the Constitution and the law.

We raised the alarm from the Nation’s Attorney General’s Office to the JEP for the repeated failure of an effective institutional response to victims of enforced disappearance, despite the Constitutional Court’s authority to declare it. We found the ineffectiveness and lack of inter-agency coordination of the institutions responsible for the location, exhumation, identification and effective delivery of bodies. Therefore, we reiterate that this clear and pervasive ignorance of the fundamental rights of victims of enforced disappearance must be overcome.

Today, the Office of the Chief Public Prosecutor has 833 special offices in criminal cases for sexual offenses, and special offices have been assigned to judicial lawyers in family matters in association cases that occur in educational institutions and a sports club.

The number of cases has always been alarming, but it is clear that they are underreported. Now, with greater access to media and social networks, there are more complaints and widespread information regarding this issue. Also, we are now more aware of some denaturalized sexual violence, and so more reporting of these incidents contributes to the visibility of these incidents and measures such as the implementation of more virtual and expedited service channels to prevent this scourge. , to receive complaints of sexual violence. Feminist and human rights movements have also succeeded in ensuring that people do not remain silent, which raises grievances.

The invisibility of crimes against girls, women and various individuals in the context of the country’s armed conflict has led to their being treated as final or concurrent crimes in the courts when their nature and magnitude necessarily necessitate a supportive priority approach. cleansing the patriarchal society that allowed them.
But what needs to be done right away to get sexual harassment under control?
The goal should not be to control it, but to destroy it. And I think it’s already a great advance that we’re talking about sexual harassment as one of the different forms of sexual violence, because we can’t refer to all sexual violence in the same way. The classification of sexual harassment as a crime by Law No. 1257 in 2008 represents a major advance in this direction.

Efforts should be made to educate citizens about the seriousness of such behavior and to remove it from all social practices. Preventive and educational studies should be carried out, the phenomenon as an expression of historical discrimination against women should be made visible, investigation, sanction and compensation processes should be strengthened.

The role of the Ministry of National Education and educational institutions is essential to prevent such violence through pedagogy, to prevent macho and misogynistic attitudes and practices of men towards women, girls and women, and they have significant difficulties in this regard. End gender stereotypes that objectify and objectify women’s bodies, and design sexual and reproductive rights programs that allow girls, boys and adolescents to have the tools to know their rights, to set boundaries for their bodies, to consent and, above all, to educate children. from the concept of corresponding and jointly responsible, non-violent masculinities.

We respect judicial decisions and the Constitutional Court. It will be crucial for the country as it could change the way it fights corruption. I am confident that the agency will analyze all the elements that are part of the country’s institutional structure, the state freedom structure, and the seriousness that many people have about disciplinary impunity. officials elected by the people.
