The disposal company has no authority to deal with human remains. The lawsuit also alleges that Sanford employees repeatedly mishandled, mislabeled, failed to separate medical waste, and used improper containers that could leak.
The lawsuit follows the turbulent relationship between the two companies, which have signed 10-year contracts to recycle and dispose of waste. Sanford’s own medical waste incinerator has faced complaints before and was shut down for not meeting emissions standards. The situation escalated when a Sanford employee allegedly broke into the MWT facility, tampered with waste containers, and arranged for a photo shoot to demonstrate the non-compliance.
Later, MWT discovered the body hidden in the container and promptly destroyed it, reporting the incident to the regulatory authorities.
Sanford Health denies all claims and plans to file a counterclaim.
