The Intellectual Rights Court did not hear the claim of Kaluga Distillery and Vodka Factory (KLVZ) “Crystal” for the early termination of protection in the Russian Federation of trademarks assigned to Disney Enterprises.
“The claim is completely dismissed,” says the decision in the arbitration case file.
We are talking about the “Pirates of the Caribbean” and Pirates of the Caribbean: Dead Man’s Chest brands. The reason why KLVZ tried to remove the safety signs through the court was the lack of alcohol consumption in the classrooms. According to Rospatent, the trademark in Russian was registered in 2015, in English – in 2007.
Kristall filed a lawsuit in an intellectual property rights court in April of this year. The company argued its lawsuit by saying that the trademarks are not used in any way in the class of alcoholic beverages. At the same time, the plant itself intends to expand its line.
At the end of 2022, Kristall’s revenue increased by 48% and amounted to 2.2 billion rubles. Net profit reached 115 million rubles (+138%). The plant owns the rights to trademarks such as “Fantomas” and “Gladiator.”
Previously, the company had already filed claims against the activities of foreign companies. Last fall, the plant went to the Federal Antimonopoly Service claiming that German manufacturer Jägermeister had violated antitrust laws.
Kristall then accused the company of pressuring and trying to prevent him from producing his own bitters. They were supposed to replace the main drink produced by Jägermeister on the Russian market.
In the context of the conflict, the Ministry of Industry and Trade was going to exclude Jägermeister products from the list of goods permitted for parallel imports.
