Netflix representatives also added that using or adopting new and innovative technologies may increase their risk of exposure to intellectual property claims, and that it is unclear whether copyright protection exists for AI-generated materials.
Note that the use of artificial intelligence by studios has become a hot topic for two Hollywood unions, WGA and SAG-AFTRA, who are going on strike in 2023 out of fear that the technology will deprive them of their livelihoods.
For example, the WGA’s final agreement includes restrictions on the use of generative AI in the creative process; including a provision giving the union itself the right to object to authors’ existing work being used to train artificial intelligence programs.
SAG-AFTRA’s agreement with the studios includes some, but not all, of the union’s demands regarding artificial intelligence; For example, the agreement allows AI models to create synthetic characters by “learning” from players’ performances.
The only way players can avoid this is if the final product includes recognizable facial features.
