The Ministry of Digital Development is going to change the rules to include companies in the register of accredited IT companies in such a way as to prevent the entry of foreign structures, Kommersant reports. Now the registry includes subsidiaries of Huawei, Samsung and others.
Sources from the newspaper reported that subsidiaries of foreign companies that are already registered in the registry will be excluded from it.
The Ministry of Digital Development confirmed to the publication the change in the rules for the accreditation of IT companies, adding that they are planned to come into force no earlier than July 1, 2025.
The department clarified that a mechanism is being discussed according to which a Russian legal entity can count on accreditation, “in which the total proportion of direct and (or) indirect participation of Russian persons is more than 50% of the total number of votes that fall into shares (participations) with voting rights, with compliance with other applicable accreditation requirements.”
How the procedure for accreditation of IT companies in the registry of the Ministry of Digital Development is now determined:
- There is Resolution No. 1729, which lists the criteria by which a company can qualify for inclusion in the registry.
- The company must have an OKVED profile and a website describing products and services.
- The share of revenue from IT activities should be more than 30%.
- The Ministry of Digital Development may deny accreditation if the company is 50% or more owned by the State, if it is a bank, a large telecommunications operator and under other conditions.
- There are currently no requirements for Russian beneficiaries.
Inclusion in the registry of the Ministry of Digital Development provides a number of tax and other preferences, including the possibility of deferring military service and mobilization of employees. Russian developers previously called for closing registration for foreign companies, noting that they steal personnel from domestic organizations, including for relocation abroad.
