Although the details are still unclear, it appears that GitLab is acting out of caution rather than the eventual legal defeat of Suyu. Nintendo had previously pursued another Switch emulator, Yuzu, but the details of the Yuzu incident and its impact on the Suyu codebase are unclear.

The deletion request itself also raises questions. Legal experts note inconsistencies in the request, including possible confusion between sections of the DMCA and a lack of clear identification of the allegedly copyrighted work. Juice even claims to have avoided workarounds that left Yuzu in the hot hands of Nintendo.

However, the validity of the request may not matter. GitLab, like most platforms, reserves the right to remove content at its discretion, and a potentially lengthy legal battle may not be worth the risk of a direct lawsuit from Nintendo.

Although Suyu developers don’t seem to have calmed down, they have promised to find a “new home” for their emulator.
