In April, the FAS conducted an inspection and found more than one violation of antitrust legislation in Wildberries’ offering. Last week, the market announced better working conditions for sellers. However, the Association of Electronic Commerce Market Participants (AUREC) believes that the site has fulfilled only part of the requirements of the antitrust service, writes Forbes.

AUREK specialists claim that some of the changes made to the Wildberries offering do not comply with FAS regulations, but rather circumvent them.
For example, the FAS forced to establish the causes of the unilateral termination of the contract by the market. Wildberries complied with the order, leaving the clause “other cases provided for by law.” This “keeps open the list of reasons for termination of the contract,” AUREK said in the letter.
In addition, the changes did not affect elements that limited the seller’s access to functions such as reports and order statuses in case of non-acceptance of the offer. The Antimonopoly Service demanded that the possibility of different sanctions for the same violations be excluded from the document. AUREK considers that this requirement was not met, as the market stated that it reserves the right to review the amount of the fines at its discretion.
The FAS also demanded that Wildberries’ liability limitations be removed in case of illegal termination of the contract, but the market also did not comply with this.
Under the updated conditions, the site still has the opportunity not to compensate for lost profits under any circumstances. The company also did not publicly publish all versions of the offer indicating its validity period. However, at the time of application to the FAS, only five of the 56 editions of the offering are available.
The association asked the FAS to ensure that the company fully complied with all requirements. Representatives of the service reported that they have not yet received the letter from AUREK.
