The Tver-based Afanasy Holding has won a lawsuit against the major beer producer AB InBev Efes and defended its right to use the Tverskoy Kozel brand, according to the case file.

AB InBev Efes, which produces Velkopopovicky Kozel beer, challenged the decision of the Federal Antimonopoly Service (FAS) on the competitor’s logo and slogan. The company contacted the supervisory authority in 2022 and explained that Tver Goat products and the image of a goat on the packaging are very similar to those used in the production of its products. The “Original Goat Image” was previously registered by the manufacturer as a unique trademark.
The plaintiff also provided an expert opinion on the similarity of its logo to the Afanasia brand. The expert noted that similarities may lead to confusion between the brands and loss of uniqueness. AB InBev Efes believes that the competitor gained “significant benefits” for the business and increased sales due to poor consumer choice.
The two companies have not yet commented on the decision of the Arbitration Court of the Tver Region.
Arbitration courts have already denied Rosalkogoltabakcontrol permission to close the Yuzhny Pivovar LLC brewery in the Rostov region three times. Tests have been carried out since April, but the enterprise, which was found to have inadequate equipment capacity, continues to operate.
