Last year, a lawsuit filed by Company X alleged that California law violated free speech. Although a lower court had previously denied X’s request for a preliminary injunction, an appeals court overturned that decision. The court ruled that the law’s requirements were “more extensive than necessary” to “achieve the state’s goal of transparent content moderation.”
The timing of the lawsuit is notable given recent criticism of X’s content moderation practices: Following Elon Musk’s purchase of the platform, X significantly cut its content moderation team, leading to continued criticism over misinformation and “hate speech.”
California Attorney General Rob Bont’s office said it was reviewing the court’s opinion and would decide on further legal action. X called the decision “a victory for free speech.”
