The suit was filed for infringement of its copyright in works and related rights in phonograms. The statement of claim against SBA LLC Music Publishing” was filed in February and the third party included in the list was Warner Music LLC. At the meeting on September 17, the court, at the request of the plaintiff, transferred this company to the category of defendants.
The court also accepted an increase in claims “by several million rubles” – they were added to the new co-defendant.
Rybnikov previously had licensing agreements with Warner Music structures, but these have now been terminated. The plaintiff claims that the defendants published Rybnikov’s works outside the terms of these agreements and violated his rights. The defendants in the suit do not recognize or understand exactly what works the composer is talking about.
Today the hearing was postponed until November. It will be established later whether the claim concerns 246 or 254 works. The plaintiff was asked to provide a complete list of works and phonograms for which he is defending the rights. Rybnikov himself was invited to the hearing to answer questions.
In July, the intellectual property rights court refused to hear a lawsuit filed by Russian hip-hop artist Egor Rakitin (Big Baby Tape) against Warner Music. The artist demanded to recover 185 million rubles from the company.
