Xu went to court, but his case was dismissed by the Beijing Third Intermediate People’s Court in mid-April 2023. Xu also forfeited his right to compensation of 620,000 yuan (approximately $90,000).

The discussion began in July 2019 when Xu applied for two weeks of paid leave, but his request was denied due to work requirements. Later, Xu declared the presence of the disease, provided medical documents, and was sent on sick leave instead of paid leave.

Soon, however, Xu’s colleague noticed him at the Hainan Island airport during his sick leave and informed the company management about it. In response to questions from the management, Xu stated that he was at home in Beijing and was not traveling.

Two days later, the company fired the man for “fraud and dishonesty”, which led to a business dispute. The Labor Court awarded Xu 620,000 yuan in compensation for violating labor laws, but the company appealed the decision.

The Supreme Court overturned the compensation, ruling that Xu had acted against the doctor’s recommendations for bed rest.
