The decision of the subcommittee of the government commission for the control of foreign investments was reported to RBC by sources familiar with the content of the decision. The information from the interlocutors of the publication was confirmed to the publication by the director of the Nikolaev and Partners Bar Association, Yuri Nikolaev.
As for the “voluntary” contribution, now 25% of the transaction amount must be paid to the budget within a month from the date of its conclusion, two RBC sources clarified. 5% should be contributed to the budget within one year and another 5% within two years.
If the amount of a transaction for the sale of a company in the Russian Federation by foreigners exceeds 50 billion rubles, it will be necessary to obtain permission from the president, Nikolaev said. According to him, the authorities also plan to amend the legislation, which will affect the withdrawal of funds abroad in the form of loans and dividends.
In 2022, a government commission introduced a “voluntary” contribution to the budget in the amount of 15% of the transaction amount for the sale of Russian companies by foreigners. In this case, transactions must be carried out with a mandatory 50% discount on the market value of the business.
From January to March 2024, the budget received 35.7 billion rubles from such transactions; The funds received exceeded the annual plan by 17 times. At the end of 2023, free budget revenues of companies amounted to 116.5 billion rubles.
