The 6-1 decision upheld a 2023 court ruling in favor of 16 teenage plaintiffs who claimed the state’s pro-fossil fuel policies violated their “constitutional rights” to a “clean and healthy environment.” That right “includes a stable climate system,” Chief Justice Mike McGrath wrote.
The lawsuit, filed by plaintiffs ages 5 to 22, was the first such case to be filed in court in the United States. Meanwhile, Montana’s Republican attorney general criticized the court’s decision, saying the state lacks the ability to influence the climate.
