The distributor of crystals, beads and rhinestones, Ekristal, filed a lawsuit against Swarovski’s Russian subsidiary, Swarovski. It demands removing restrictions on the sale of goods previously imported into Russia under its brand.
Consideration of the claim is scheduled for the end of September, Vedomosti writes with reference to the basis of the Moscow Arbitration Court.
The lawsuit alleges that in 2021, the subsidiary offered the partners to sign an agreement to control the use of the Swarovski brand in the sale of goods without separate authorization.
“Ekristal” signed the agreement “under the threat of a reduction in the volume of supplies and subsequent early termination of the contract.” The supply contract was terminated, but the distributor still has stocks of legally imported products from the Austrian group, which the company can no longer sell.
Swarovski in early March ceased all business activities in Russia, closed 12 stores and stopped the online store.
Ekristal said in a statement that Swarovski requires the distributor to remove mention of Swarovski from its website and sell anonymous products. Not to mention the price will be at least twice as low, the report says.
Therefore, the company insists that there is no violation of the rights of the Swarovski brand, whose goods were imported into Russia by the copyright holder or with his consent, the newspaper’s interlocutor said. According to him, Swarovski may not have the right to use this trademark.
