The Intellectual Property Court invalidated Rospatent’s decision to leave the protection of the Fantola trademark to the company Drinks from Chernogolovka.
The authority’s decision dated January 14, 2022 indicated that the Fantola trademark was registered on May 17, 2019.
“Recognize the non-normative legal act as completely null,” says the case file on the court’s website.
The American company The Coca-Cola Company in December last year tried to challenge Rospatent’s decision. The request was not granted, after which Coca-Cola went to court. The company believes that the Fantola brand resembles the Fanta trademark protected since 1966.
Coca-Cola was one of the first foreign companies to announce the end of its business activities in Russia due to the events in Ukraine. According to analysts, in the first half of 2022, the number of analogues of the popular drink Coca-Cola in Russia increased by 10%.
In September, the Russian fast-food restaurant chain Vkusno-i Totka announced that it would return to selling “drinks with all your favorite and familiar flavors” on tap.
