The Ministry of Labor and Social Welfare has drawn up a bill on the modification of the rules to counteract and resolve conflicts of interest between officials. Civil servants and security forces will be threatened with dismissal for inaction in a conflict of interest between subordinates.

The Ministry of Labor of the Russian Federation proposed to dismiss the bosses due to a conflict of interest of the employees.

The proposals passed interdepartmental coordination and were sent to the government, the ministry’s press service told RBC.

The bill requires managers to inform their superiors if they have a “personal interest that results or may result in a conflict of interest.”

The boss must take measures to prevent or resolve the conflict situation. If he doesn’t have the authority to do so, then he must inform upper management. Otherwise, the boss can be fired “for loss of trust.”

The document also provides for the actions of the leader if he finds out about the conflict of subordinates. You can offer the subordinate to refuse the benefit received or expected to receive, to strengthen control over the performance of official duties by the subordinate, or to remove the employee from a controversial assignment.

According to BGP litigation partner Anatoly Loginov, the current legislation also provides for penalties for the lack of management measures to resolve conflicts of interest between employees. In case of breach of such duties, the authorities face disciplinary responsibility, which does not necessarily imply dismissal.
