Elephant Happy from New York is fighting her rights in court – legal resource advocates have decided for a stable legal personality in Europe. Lawyers for the Nonhuman Rights Project have filed a lawsuit on Happy’s behalf, investigating rights and occurrences at the Bronx Zoo, where she’s been retired since 1977 and taken to when she was 6 years old. “The elephant ended up in the hospital against her will,” says NRP lawyer Happy. “For over 40 years she has been living in captivity.”
According to NRP, in 2005, Happy was the first of the elephants to pass a self-recognition test in reflection, which is revealed by acquaintance with the existence of self-awareness in a living being. That same year, her enclosure neighbor Sammy was euthanized due to kidney failure, and since Happy no longer gets along with any of the zoo’s other elephants, she’s been virtually alone ever since.
After Sammy’s euthanasia, zoo officials said they would stop keeping elephants in captivity as soon as another of their elephants died, but so far they haven’t done so. Happy is in good health, although she is now over 50 years old, but she is called “the loneliest smwe”. She is often kept in cramped enclosures, in an area not much larger than her own collection.
