The Supreme Court of the Russian Federation did not satisfy the appeal of the 2GIS service with a request for cancellation of the charge of expenses in the case of a negative user review of the Sibprom corporation. The judicial authority ruled that the owner of the site is responsible for disseminating information about the complainant.
According to the Pravo.ru portal, in July 2021, on the 2GIS map, a user with the nickname Vitaly Berezovsky left a negative review about the financial and industrial corporation Sibprom. In particular, the author of the comment criticized the head of the company, business relations and the work of the company.
According to the file of the arbitration cases, the plaintiff demanded that the review be recognized as false and discredit the reputation, force 2GIS to delete the comment and charge 15,756 rubles from the service for compiling a notarial protocol for inspecting the site and 6,000 rubles for state duty.
The court granted Sibprom’s requirements. The organization was not convinced by 2GIS’s arguments that someone else violated the complainant’s rights. According to the agency, the site owner had the technical ability to remove the comment.
During the proceedings, the judge suggested that 2GIS assume the position of author of the review, since it refused to remove the information in a pre-trial order.
The Economic College annulled the act of cassation and confirmed the acts of lower instances. 2GIS, which is the defendant in the case of discrediting the information, must compensate the cost of a notary and a state duty.
