Apple has a problem: New complaint over failure to repair water-damaged iPhones
Class action lawsuit focuses on “Apple’s contradictions” regarding iPhone water resistance!
This week, Apple sued for refusing to repair water-damaged iPhonesDespite the company’s claims that its devices are resistant to liquids, the new legal action filed in Quebec, Canada, joins a number of similar lawsuits questioning the accuracy of Apple’s advertising promises and the protection provided by its warranties.
Apple must respond to iPhone water resistance
One of the most representative cases is that of a 19-year-old student whose iPhone was damaged by water. Despite Apple’s claims about the durability of its devices, the company refused to cover the cost of repairs. He claims that the warranty does not cover damage caused by liquids.
This led attorney Joey Zukran to question Apple’s claims regarding the iPhone. According to Zukran, it’s contradictory to advertise that the iPhone can be submerged in a pool and at the same time exclude water damage from the warranty. The lawyer argues that this apparent contradiction violates consumer rights and must be corrected.
The class action lawsuit aims to represent all Quebec consumers who have suffered similar harms. The main objectives of the case are:
- Remove the “liquid contact” clause from the warranty.
- Reimbursement of repair costs.
- $500 compensation for each affected customer.
As one of the most valuable and valuable companies in the world, Apple has experience in such legal processes, but the lawyer representing this user group is alsoIn 2019, Zukran filed a lawsuit against the company over the battery life of the iPhone, and the court ruled in favor of the lawyer.
But Apple has some precedent when it comes to water resistance. In 2022, a US court dismissed a class action lawsuit against Apple over alleged misleading advertising about the water resistance of its iPhones.
At the time, Judge Denise Cote ruled: Plaintiffs failed to provide sufficient evidence to prove Apple deceived them or that they base their purchasing decisions on water resistance claims.
Apple was fined 10 million euros by Italy’s antitrust watchdog in 2020. The decision sanctioned “unfair commercial practices” related to the marketing of the iPhone in the country, particularly the device’s water resistance.
What does Apple say about the iPhone’s water resistance?
