Until now, the rights attached to music, for this particular use, have been generally acceptable. This is due to an agreement between the SIAE and SoundReef LEA But now everything changes: from today, the payment of the fee for the license to reproduce the background music in public places will only cover the authors registered with the SIAE. THE rights to authors SoundReef subscribers are paid separately.

Since there are more and more and there are currently no conventions, the risk of another bloodletting is just around the corner.

The question is important. The musical backgrounds are very common, think of supermarkets, but also hairdressers and many other companies that we usually visit. Rights have variable costs, which mainly depend on the size of the company: the larger the square footage, the higher the costs.

However, for the exhibitor to check maniacally which artists are registered with the SIAE and which ones instead LEA it is practically impossible. That would be too much of a task. Not to mention those exercises that don’t have a playlist of their own, but are limited to playing the radio. Technically, they should switch channels every time an LEA protected track is broadcast. In short, you understand.

As if all this were not enough, some exhibitors point the finger at the rates imposed by the SIAE, which, despite not renewing the agreement with Soundreef, has not reduced its prices at all. Paradoxically, they will have to pay the same fee to get less. And then – to avoid an eternal sword of Damocles – they will also have to pay the dues to the PWA.

BothAGCOM that the Ministry of Culture have opened a file on this. Further developments can be expected in the near future. Pending a possible solution, the problem currently exists and is very serious.
