The agency filed two complaints, both accusing Tesla of formulating its marketing proposals in a “misleading or untruthful” manner. In short, the accusation is of misleading advertisement. First of all, the motorization points the finger at the branding choices: Fully self-driving and Autopilot are two names that indicate that Tesla cars are equipped with fully autonomous driving technology, which is not true. Autopilot, even when equipped with the FSD package, is at most an advanced ADAS, or what might be called level 2 autonomous driving.
After all, the driver must keep his hands on the wheel when the function is activated and must also be ready at any time to regain control of the vehicle.
The agency also mentions several phrases in Tesla’s promotional materials. For example: “Autopilot is designed to support short and long journeys without the need for the person sitting in the driver’s seat to do anything”. But also: “Autopilot can navigate within urban roads, complex intersections and highways”.
Ambiguous sentences, reinforcing the idea that the cars produced by Tesla can function as authentic self-driving cars. “It was not true at the time of those advertisements and it is still not true now”, thunders the RDW.
The ramifications of the complaint filed by the DMV could be very serious: Tesla is in danger of losing its license to sell its vehicles in California. Tesla has 15 days to respond to the agency’s complaint.
