The complaint alleges that Pornhub violated the EU General Data Protection Regulation (GDPR) by processing user data without their consent. The platform has been accused of “illegal profiling” by using a referral system to determine users’ sexual preferences without their knowledge, and as a result, transferring sensitive information for financial gain.

The authors emphasize that platform trackers are difficult to remove and are designed to bypass opt-out options. Pornhub’s parent company, MindGeek, did not comment on the ongoing litigation, but expressed its commitment to protecting user privacy.
