The New York Times (TNYT) has filed a lawsuit against OpenAI and Microsoft regarding training AI robots using articles from the publication, CNN reports.

According to the publication, the companies illegally used “millions” of texts published on TNYT to train their chatbots and other artificial intelligence-based services. This has led to the fact that now these services can compete with publishing.

The lawsuit was filed in Manhattan District Court. It does not make a specific monetary demand, but states that the defendants should be punished for “billions of dollars in legal and actual damages.”

According to the plaintiff, “the defendants seek to take advantage of the NYT’s enormous investment in its journalism” without investing anything in their own content. The lawsuit also demands the destruction of all bot models and training data that use the newspaper’s copyrighted content.

The New York Times referred to its previous call to Microsoft and OpenAI, in which the newspaper proposed to resolve the situation out of court. These were commercial agreements and “technological solutions” in relation to products through which AI solutions are trained. The parties were unable to reach a consensus.

OpenAI, in turn, expressed disappointment with the NYT’s lawsuit. The company valued the negotiations with the publication as a constructive advance.

In early December, OpenAI announced a partnership with the largest European media holding company, Axel Springer. This will give the ChatGPT chatbot access to the media produced by the publisher, in particular Politico, Bild, Business Insider, Welt and others.
