A US federal court overturned its order that Elon Musk must testify before the Securities and Exchange Commission (SEC) in his Twitter acquisition case in 2022. Judge Laurel Biller recalled that the billionaire has the right to explain why who doesn’t want to testify.

According to Bloomberg, the judge admitted that she made a mistake in ordering Musk to comply with the requirement to testify before the SEC.

Laurel Biller said she “overlooked the fact” that the businessman exercised his right in October to refuse to give her the final say in the dispute, and that only a higher authority can have the final say.

Biller referred the case to a district judge and the ruling, issued on February 10, is now purely advisory.

Last week, a California judge ordered Elon Musk to testify before the SEC, siding with the agency, which filed a lawsuit in October against the businessman who refused to meet in September 2023.

The businessman then refused to testify before the SEC as part of an investigation into possible violations in the $44 billion purchase of Twitter, saying he had already done so twice and accusing the SEC of harassment.
