The decision came after Musk’s lawyers filed a motion challenging Magistrate Judge Laurel Beeler’s December 2023 decision, which sided with the SEC, which suspected Musk of violating disclosure laws for his Twitter stock purchase and public statements about the deal.

But Musk claims he has already cooperated with the SEC by appearing in two previous interviews and accuses the regulator of “harassment”. He now has the opportunity to present his arguments against the subpoena to a district court judge, which could result in overturning the original decision.
