The Viola company filed a lawsuit with the Arbitration Court of the Amur Region against the regional department of the Federal Antimonopoly Service, RBC writes with reference to a file of arbitration cases.
Previously, the manufacturer Viola sent a complaint to the Amur OFAS about the “Hladokombinat Partner” in connection with what Viola considered a similar packaging of yogurt. We are talking about the “Farmstead” brand.
In response, the service published a voting post on its Telegram channel to 124 subscribers, asking them to evaluate the similarity of the two packages. 67% of survey participants chose the option “yogurts have a standard product packaging solution.”
As stated by Viola, the yogurt lines of Viola LLC and Khladokombinat Partner LLC have “identical external packaging characteristics.”
The press service clarified that the similarity is noticeable in the compositional structure of the elements and in the color combination of the key elements of the packaging. We are also talking about “original visual elements that imitate a series of brands.”
Viola has been producing yogurts with this design since 2019 and the appearance of the “Farmstead” product was recently updated, the company says.
Previously, the Kari network filed a lawsuit against the Federal Antimonopoly Service with the intention of challenging the refusal to open a case for violation of antitrust laws by the company that owns another Zenden network.
It should be noted that Zenden used the word kari in its advertising, which the competitor claims misled users.
