Many violations of antitrust legislation were found in Wildberries’ offer and in market working conditions with counterparties. This was reported by the press service of the FAS.
The department noted that Wildberries’ offer contains conditions that appear to impose unfavorable conditions of cooperation on sellers. The FAS also highlighted that the market changes storage rates for goods and logistics services “almost daily”, which can significantly affect the activities of sellers.
In addition, the service considered the amount of fines that Wildberries imposes on sellers in case of hacking of their personal account by third parties to be disproportionate. In addition to the above, the FAS noted uncertainty over the conditions for changing Wildberries’ rates for logistics and goods storage services, and the imposition of fines on sellers for unauthorized access to their personal accounts.
The FAS indicated that these actions had signs of violating antitrust legislation and issued a warning to Wildberries. The company was obliged to make changes to the offer and suspend practices that contained signs of violation of the law.
“At the same time, the application of the warning should not lead to a worsening of conditions for Wildberries’ counterparties,” the FAS noted.
If Wildberries does not comply with FAS requirements, the agency will have the right to bring a case against the market for violating antitrust laws.
Wildberries promised to study the warning as soon as the company receives it.
“We have already listened to the recommendations of the FAS Russia on the voluntary self-regulation regime and put them into practice. We pay close attention to the regulator’s comments and base our work on meeting the service requirements as a genuine market participant,” they said in the Wildberries press service.
On March 20, 2024, the Russian government lifted the moratorium on antitrust inspections of IT companies, including Wildberries. The government decree came into force on March 28.
