The Rospatent Patent Disputes Chamber panel made the decision to ban the sale of certain products under the Vivino brand in Russia, RBC writes.
The owner of the Vivino brand, the Danish company Vivino ApS, which developed a mobile application of the same name for selecting wine, filed a complaint for illegal use of the brand. In January 2022 she registered a trademark with Rospatent with exclusive rights to use it.
Alexander Kaspin, a resident of Tatarstan, registered a similar trademark in February 2022, after which he transferred the license to use the trademark to Gifts Wholesale LLC. This company sold drinking glasses under the Vivino brand.
Vivino complained about the misuse of the trademark, to which Kaspin pointed out that the Danish company has no plans to use the trademark and that the application developed by the company is not unique.
Rospatent noted that Vivino’s application ruled that the Vivino application was known in Russia before Kaspin registered the trademark, and products sold under license under this trademark could mislead consumers.
The Kaspin trademark has been partially removed from legal protection; It is now prohibited to sell under it some products related to wine consumption, for example, glasses, corkscrews and items for storing wine and beer.
