The judge said the lawsuit did not provide enough evidence to show exactly how the corporate policy affected employees with disabilities. The lawsuit was filed by former Twitter engineering manager Dmitry Borodaenko, who claimed that the ban on remote work violated the Americans with Disabilities Act (ADA).
Borodayenko claims he has a medical condition that makes him vulnerable to Covid-19 and that this prevents him from working in an office. However, the court disagreed with his version, stating that not all disabled employees need to work remotely. The judge gave the plaintiff four weeks to submit amended documents with more detailed allegations and evidence.
Elon Musk’s companies have strictly banned remote work, even for the IT sector. For him, working from home is a moral issue. He believes it is unfair discrimination against employees who already work in industries where they have to work, such as factory workers or delivery drivers. “Meanwhile, the white-collar class lives in la-la land,” Musk said in an interview.
