The international laboratory service “Helix” (Russian legal entity “NPF “Helix” LLC) has given its consent to Johnson & Johnson to use its trademark in Russia for the corresponding group of products. The Court of Intellectual Rights upheld the lawsuit of the American company against Helix regarding the transfer of rights to the trademark, wrote RB.RU. At the time of this publication, the parties had already reached an agreement. At the moment there is no conflict between NPF Helix LLC and Johnson & Johnson, according to the laboratory service.
“Johnson & Johnson owns a brand that is confusingly similar to the Helix brand. Under this brand, Johnson & Johnson produces products that are not related to laboratory diagnostics. Due to the likelihood of trademark confusion and the requirements of Russian legislation to obtain permission from the rights holder to use a similar trademark, Johnson & Johnson turned to Helix and an agreement was concluded between the companies on the possibility of Johnson & Johnson will use his brand. in the Russian Federation for products of the corresponding group,” said Daria Goryakina.
The lawsuit filed by Johnson & Johnson was left without progress by the court and will be returned to the applicant, Helix added.
The Helix laboratory service continues its development not only in Russia, but also in the CIS markets.
Throughout the 9 months of 2024, the commercial network of the Helix company increased by 77 new points, both in franchise and ownership. Until the end of the year, the laboratory network will grow with hundreds of new points in cities such as Moscow, Saint Petersburg, Yekaterinburg, Krasnoyarsk, Chelyabinsk, Samara, Togliatti, Tambov and others, according to the company.
The laboratory service is also developing in the markets of the CIS countries. Helix already operates in the Republic of Belarus and Kazakhstan. The laboratory service’s immediate plans include entering the markets of Uzbekistan, Tajikistan, Kyrgyzstan, Azerbaijan and Armenia through a master franchise. The company intends to open at least 30 points a year, both franchise and subfranchise, in each country, as well as locate laboratory complexes. The exact number of vacancies will depend on the specific market and the conditions of cooperation with partners, the company added. There are currently around 800 operating points in the network.
