Crypto.com emphasizes that although Bitcoin and Ethereum have certain exemptions, other “crypto assets” should also have similar privileges. The exchange also criticizes the SEC for ignoring basic procedural rules, including notice and comment requirements under the Administrative Procedure Act.

This lawsuit aims to stop what Crypto.com describes as the SEC’s “illegal” campaign against the entire crypto industry.

In addition to the lawsuit, Crypto.com has filed a petition with both the SEC and the Commodity Futures Trading Commission (CFTC) calling for a clearer regulatory structure for cryptocurrency derivatives in the United States.
