A U.S. appeals court has upheld a lower court’s ruling that dismissed a lawsuit alleging that Apple honestly defrauded customers to keep them paying for iCloud.

The company was accused of convincing customers that they could easily stay under iCloud’s mandatory 5GB limit. But space quickly runs out, so use the extra storage space.

The appeals court ruling found that the plaintiffs failed to demonstrate that they were inevitably required to pay for iCloud and that the subscription could not be cancelled. At the same time, the plaintiffs themselves did not pay for iCloud and used 5 GB of storage.

This lawsuit was initially dismissed by the US District Court in Northern California in May 2022. However, two plaintiffs filed an appeal, which is now also dismissed. The case is closed for now, but could be reopened if the plaintiffs return to the U.S. Supreme Court.
