According to Rospatent materials, Wildberries LLC filed an application for recognition of the verbal designation Wildberries as a well-known trademark on December 18, 2023, but withdrew it on September 3, 2024. On November 5, Rospatent granted the application for the company and did not make any changes.
If a name is recognized as a well-known trademark, it can only be used by the company that registered it. Furthermore, you cannot transfer it to another legal entity. “That is, Wildberries LLC could not transfer [бренд Wildberries] new structure – RVB LLC. In court we want Rospatent’s decision to be annulled and the trademark to be recognized as well-known in order to be able to challenge subsequent actions to transfer the RVB trademarks,” Logunov explained.
According to the lawyer, Bakalchuk previously notified Rospatent and the Federal Institute of Industrial Property (FIPS) “that there was a business conflict and that the transfer of trademarks should not take place,” but his arguments were not taken into account.
The businessman’s lawsuit against Rospatent was registered on December 3, the court left it without action until January 10, 2025 due to lack of the necessary documents to consider the case. According to Logunov, the documents were submitted electronically, now it is necessary to present the originals. “We hope for a positive decision: that the transfer of the rights to the Wildberries brand to RVB be cancelled,” he emphasized.
Anna Gileva, director of the Everlex law firm, called the probability of winning the lawsuit low and noted that Rospatent made the decision to reject it at the request of the applicant, so “there is no dispute about the right as such.”
Wildberries and advertising operator Russ announced a merger in June to create a “modern, high-tech digital commerce platform.” As a result of the merger, the company RVB was created.
Bakalchuk, who founded Wildberries with Tatyana Kim, accused Russ of “a raider’s takeover of the business” and tried to protest the deal. In July, Kim announced that she had filed for divorce from Bakalchuk.
