The Government Commission on Legislative Activities approved amendments in the second reading of the bill to prevent the placement of advertising on the information resources of organizations banned in Russia. This was reported to Vedomosti by a source close to the government commission and confirmed by an interlocutor from the Cabinet of Ministers.

Documents attached to the bill state that most of the amendments are legal and technical in nature.

The word “non-governmental” in relation to foreign or international organizations is excluded from the Law “On Advertising”. This is because in August 2024 Vladimir Putin signed a law that allows foreign organizations in which the State has participation to be recognized as undesirable. Previously only non-governmental structures could be recognized.

The updated document states that advertising is prohibited on portals in respect of which the court has made a liquidation decision or ban that has entered into legal force. The reasons for this must be provided for in the laws on combating extremism or terrorism. Advertising on other resources whose access is restricted by law is also unacceptable.

As can be seen from the document, the discussion of the bill revealed disagreements between the Federal Antimonopoly Service (FAS) and the Ministry of Digital Development regarding responsibility for advertising. The Ministry proposed to exclude the advertiser’s liability if advertising is placed through advertising system operators, that is, if it occurs outside their control. However, the FAS insisted that the advertiser is responsible for the conditions of the advertising.

The Chairman of the Board of Directors of Sulim and Partners, Olga Sulim, in a conversation with Vedomosti, noted that placing advertising “in new realities will be quite comparable to walking through a minefield, given the regular addition of records and lists of organizations and Prohibited services blocked in Russia.”

If the initiative is adopted, advertisers will be responsible even in cases where they do not control exactly where their advertising is placed, for example, if advertising networks or automated systems are used, stressed the head of the “It&Ip Dispute Resolution” department of the the law firm “Rustam Kurmaev and Partners” » Yaroslava Shitsle.

The bill amending the laws “On combating extremist activities” and “On advertising” was submitted to the State Duma on June 21, 2024. If adopted, the new rules will come into force on June 1, 2024. March 2025.
