Gradente claims that in 2000, Apple’s first iPhone released a phone with this name 7 years ago. In 2012, Apple filed a lawsuit against Gradente trying to use world popularity, but the court could not find signs of fraud from the Brazilian company.
The President of the Gradente called it the “victory of justice ve and stressed that the company did not copy Apple, but was the first person to use it in Brazil.
Now the case is still taken into consideration in the high court of the country (STF). If Gradente is going to win there, Apple will probably have to make an agreement or apply to international courts.
So far, Gradente can continue to sell phones under the iPhone brand in Brazil.
